Maj Holdings v. Council for Development

Maj Holdings v. Council for Development (1989) was a Superior Tribunal challenge by Bran Maj to block nationalisation of railway assets under the 1988 State Enterprise Act.

Background

The Council for Development moved to transfer Maj-controlled railway assets to the state. Maj sued to enjoin the nationalisation and preserve private title.

Holding

The Superior Tribunal ruled 9–2 for the State: “strategic interest” supersedes private property. Maj’s petition was dismissed; assets transferred; no compensation formula favourable to Maj. Republic Rail was created.

Legacy
